You’ve been wronged; message to Lay Litigants and McKensie Friends

You’ve been wronged.  That’s the basic issue with your mortgage; it was unsuitable for your family.  The bank ignored the rules and you were always going to default on your payments at some stage in the future.

Now the bankers want their money back and they have chosen to threaten or take you through the commercial courts.  But that is wrong, because:

  1. You are a Consumer;
  2. European Consumer law exists (since 1993) to protect you;
  3. The European Court of Justice has ruled on these protections (mainly with respect to Polish consumer mortgages);
  4. If the banks did not follow the rules when granting you your mortgage; that is a Mis-sale;
  5. You need to take action to protect your home.

What can you do?

  1. Establish if your mortgage was mis-sold; you can do this by registering your mortgage details at www.misselling.ie. It’s free to register.
  2. If your mortgage is eligible, we file a complaint to the Financial Ombudsman (FSPO).  This service is free until you receive compensation.
  3. If you are in the Court process already or have an eviction notice hanging over your head, we can issue notices to the Debt Servicer and their Solicitor, the Court, the Sherrif and anyone else trying to take your home.
  4. Our Notices remind the lawyers and the Courts that they are dealing with a consumer and are obliged to ensure that:

The terms of your mortgage are investigated for what the European Court of Justice calls Unfair Terms in a Consumer Contract.

  • I have Unfair Terms in my mortgage
